It is a good idea to consult with an intellectual property lawyer to ensure patent viability. The patent search, description, claims, drawings, and patent fees must be valid and in accordance with the USPTO. Even though it might be expensive in the short term, having detailed and correct patent documentation will protect an invention in the long run. After an approved patent is published, about 18 months after approval, expect challenges from large corporations. Big companies with many inventions will say the new patent violates their patents, and try to get your patent thrown out. Patent defense can cost tens of thousands of dollars per month, depending upon the perceived value of the invention.
For example, if an inventor who has a patent finds out another company is distributing a similar product unrightfully; a law suit can be filed. Most likely the defending company will try and invalidate the inventor's patent in some way. If the patent can be proven incomplete or incorrect, it might not hold up in court. Better to be safe than sorry, inventors should hire an experienced lawyer to oversee the patenting process.
